USE OF THE TRADEMARK

ARKdeko' is a trademark registered with the Ministry of Economic Development on 4 October 2012 with Registration No. 0001511478, therefore improper uses and acts of unfair competition will be prosecuted according to current law.

On the basis of current legislation, with particular reference to online publications, ACTS CAPACITY TO CREATE CONFUSION are recognized as acts of unfair competition. Such behaviors are defined as behaviors aimed at creating confusion among consumers with similar products and/or activities in such a way as to exploit their commercial success. The use of confusingly distinctive signs such as the name of the company, the sign and the trademark, such as to deceive the public regarding the nature or origin of the company, is also prohibited. The law also prohibits behaviors of servile imitation, i.e. copying the shape or characteristics of the product, and behaviors of parasitic competition, i.e. those behaviors aimed at systematically imitating all the company's initiatives.
On the basis of current legislation, with particular reference to online publications, ACTS OF DENIGRATION are recognized as acts of unfair competition, with which news or appreciations are spread aimed at discrediting the activities and products of competitors and ACTS OF BOASTING, consisting of 'appropriate the merits and/or characteristics of a competing company's products.

All other acts contrary to the principles of professional correctness and capable of damaging other companies are considered acts of unfair competition.

The law recognizes and punishes acts of unfair competition and the competent judge can order against such behavior: the cessation of the illicit behavior and abstention from similar acts in the future; the removal of the effects of the act performed; compensation for damages as well as other precautionary measures.

The trademarks and distinctive signs published on this Website are the exclusive property of ARKdeko', or of third parties and, in any case, access to the Website does not give the user the right to use such trademarks and distinctive signs without the written authorization from the respective owners.
All material published on this Website is protected by intellectual property rights, in accordance with current legislation on the protection of applicable copyright.
The documentation, images and other contents of the Site are the property of ARKdeko' or third parties and protected by the respectively applicable legislation.

To protect intellectual property, all contents are deposited by ARKdeko' by registered mail certified by proof.

The law provides for some particular cases in which the partial and free use of works protected by copyright is recognised. In particular, the law recognizes:

The right to quote, that is, the partial or summary reproduction of the contents for the purposes of review, information, criticism and discussion. Anyone who uses the Right of Citation must not do so for commercial purposes that compete with any commercial purposes of the author. The right to Quote, however, provides for the OBLIGATION on the part of those who extrapolate other people's content for the intended purposes, to indicate the source exactly and in particular to indicate the author and the website from which the resource was taken.
Personal use, i.e. the ability to print or save a page of the site on your hard disk to view it offline. Printing or saving the resource, however, EXCLUDES the possibility of: republishing the resource on the Web and redistributing it through a different format (e.g. paper or cdrom publication).
In all cases other than those described in point 1 and point 2, COPYRIGHT VIOLATION will occur, which is an offense prosecutable in civil and criminal matters.

Access to the Website therefore does not provide the user with the right to appropriate, reproduce, modify, distribute or republish, in any form, even partial, the information.
